Terms of Service

Important: Drive Mart is a marketplace platform only. We do not sell vehicles ourselves. Always inspect a vehicle in person, carry out an HPI check, and verify the seller's identity before making any payment.

1. Acceptance of Terms

By accessing or using Drive Mart ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all users including buyers, sellers, trade dealers, and visitors. These terms are governed by the laws of England and Wales.

2. The Platform

Drive Mart is an online marketplace that connects vehicle buyers and sellers across the United Kingdom. We provide the technology platform and tools to facilitate listings, auctions, and communications between parties. Drive Mart is not a party to any transaction between buyers and sellers and does not take ownership of any vehicle listed on the Platform. Drive Mart acts as an introducer only.

3. User Accounts

To list vehicles or place bids, you must create an account and verify your email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Platform. You agree to provide accurate, current and complete information when creating your account. Drive Mart reserves the right to suspend or terminate accounts that breach these terms.

4. Listings & Seller Obligations

Sellers are responsible for the accuracy of their listings. All information provided must be truthful, accurate and not misleading under the Consumer Protection from Unfair Trading Regulations 2008. Sellers must disclose any known faults, outstanding finance, accident history, or mileage discrepancies. Drive Mart reserves the right to remove any listing that violates these terms, contains false information, or is otherwise inappropriate. Sellers must own the vehicle they list or have legal authority to sell it. Listing fees are non-refundable once a listing is published and live.

5. Auctions

Auction listings are subject to additional terms. When a seller lists a vehicle for auction with a reserve price, they are obligated to sell to the highest bidder if the reserve is met. Bids are binding. Once placed, a bid cannot be retracted except in exceptional circumstances at Drive Mart's sole discretion. The highest bidder at auction end is obligated to complete the purchase. Drive Mart reserves the right to cancel auctions in cases of suspected fraud, shill bidding, or technical error. Auction listings are free to post; no listing fee applies.

6. Trade Sellers

If you are a trade seller (a business selling vehicles in the course of a trade), you must clearly identify yourself as a trade seller on your profile and listings. Trade sellers must comply with the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, and all applicable FCA regulations if offering finance. Trade sellers are responsible for ensuring vehicles meet roadworthy standards and all relevant legal requirements before sale.

7. Buyer Protections

Drive Mart strongly recommends buyers: (a) inspect any vehicle in person before purchase; (b) carry out an HPI check to verify the vehicle's history, outstanding finance, and stolen status; (c) verify the seller's identity and that the V5C logbook matches the vehicle; (d) never pay a deposit without viewing the vehicle; (e) use bank transfer rather than cash for large transactions. Drive Mart is not responsible for the condition, roadworthiness, or legal status of any vehicle listed on the Platform.

8. Prohibited Items & Conduct

You may not list stolen vehicles, vehicles with undisclosed outstanding finance, clocked vehicles, or vehicles that do not exist. You may not use the Platform for fraudulent purposes, to harass other users, to spam, or to circumvent our fee structure. Shill bidding (artificially inflating auction prices) is strictly prohibited and will result in immediate account termination and may be reported to Action Fraud. Misrepresentation of a vehicle's condition or history may constitute a criminal offence under the Fraud Act 2006.

9. Payments

Listing fees are processed securely via Stripe. Drive Mart does not store payment card details. Transactions between buyers and sellers are conducted directly between the parties. Drive Mart is not responsible for payment disputes between buyers and sellers. We recommend using bank transfer (Faster Payments or CHAPS) for private sales and obtaining a receipt for all transactions. Be aware of scams — Drive Mart will never ask you to pay via cryptocurrency, gift cards, or wire transfer.

10. Intellectual Property

All content on the Platform including the Drive Mart name, logo, design, and software is owned by Drive Mart Ltd and protected by UK and international intellectual property laws. You may not copy, reproduce, or distribute any part of the Platform without our written permission. By uploading photos or content to the Platform, you grant Drive Mart a non-exclusive licence to use that content for the purpose of operating and promoting the Platform.

11. Limitation of Liability

Drive Mart provides the Platform "as is" without warranties of any kind. We are not liable for any loss or damage arising from transactions between users, inaccurate listing information, or technical failures. Our total liability to you shall not exceed the fees paid by you to Drive Mart in the 12 months preceding the claim. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

12. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Drive Mart complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

13. Changes to Terms

Drive Mart reserves the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Platform at least 14 days before changes take effect. Continued use of the Platform after changes constitutes acceptance of the new Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If we cannot resolve your complaint, you may refer it to an independent dispute resolution service.
